These Terms of Use (the “Terms”) govern your access to and use of the Site, any online forms or chat on the Site, and related online features provided by White Glove Plumbing (collectively, the “Online Services”). By accessing or using the Online Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Online Services.
 

 

Note: Separate written service agreements, proposals, work authorizations, service tickets, or invoices (collectively, “Service Documents”) may apply to onsite or remote services and will control in the event of a conflict with these Terms as to the work performed.

1) Eligibility & Accounts

1.1 Eligibility. You must be at least 18 years old (or the age of majority where you live) and have the legal authority to enter into these Terms.

1.2 Accounts. If we offer or you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

1.3 Accuracy. You agree to provide accurate, current, and complete information (e.g., service address, contact details) and to keep it updated.

2) Online Services; Informational Content Only

2.1 Informational Nature. Content on the Site (including articles, tips, pricing ranges, or FAQs) is provided for general informational purposes and does not constitute professional advice. Plumbing conditions vary; an in-person evaluation by a qualified technician is typically required.

2.2 No Guarantee of Availability. Online scheduling requests, preferred time windows, or confirmations generated by the Site are subject to technician availability and our acceptance. We may contact you to reschedule or request additional information.

2.3 Third-Party Tools. The Site may integrate third-party services (e.g., maps, analytics, chat, payment processors). Your use of those services is governed by their terms and privacy policies.

3) Estimates, Work Authorizations & Changes

3.1 Estimates. Any estimate provided online or by phone is preliminary. Final pricing typically requires onsite inspection and a written Service Document. Estimates are valid only for the period stated and may exclude unforeseen issues, permits, or fees.

3.2 Hidden Conditions. Plumbing systems may have concealed conditions (e.g., corroded lines, slab or wall leaks, root intrusions, code violations). If discovered, we will discuss options and may issue a change order. Additional labor, parts, or remediation may be billed.

3.3 Unforeseen Risks. You acknowledge common risks of plumbing work (e.g., brittle pipes or fixtures that may fail during normal work, discovery of mold or hazardous materials, drain line collapse during clearing/camera work). We are not responsible for pre-existing damage or conditions.

3.4 Photos/Video. You authorize us to create and retain job-site photos/video for documentation, quality control, and insurance. With your prior written consent, we may use non-identifying project media for testimonials/marketing.

4) Scheduling, Access & Safety

4.1 Arrival Windows. Any arrival time is a window, not a guarantee. Traffic, prior emergencies, and parts pickup can affect scheduling. We’ll communicate updates when possible.

4.2 Access. You must provide safe, lawful access to the property, including access to shutoff valves, panels, crawlspaces, and fixtures. You are responsible for securing pets and notifying us of hazards.

4.3 Safety & Compliance. We may decline or pause work if conditions are unsafe or non-compliant with applicable codes or if permits are required but not obtained.

5) Pricing, Invoices, Payments & Cancellations

5.1 Pricing. Prices are as quoted in the applicable Service Document or as otherwise communicated and accepted. Unless stated, prices exclude permits, disposal, specialty parts, or unforeseen remediation.

5.2 Payment. Payment terms will be stated in your invoice or Service Document. We may accept payment via third-party processors. You authorize charges for amounts due, including approved change orders and applicable taxes/fees.

5.3 Online Payments. If you pay through a third-party processor, you are subject to that provider’s terms. We do not control and are not responsible for third-party payment systems.

5.4 Late/Failed Payments. Overdue balances may incur late fees, interest as permitted by law, and reasonable collection costs/attorneys’ fees.

5.5 Cancellations. If you need to cancel/reschedule, please notify us as early as possible. Short-notice cancellations or missed appointments may incur a fee if stated in the Service Document.

5.6 Deposits & Special Orders. Deposits may be required for special-order items or large projects. Special-order items may be non-returnable once ordered.

6) Limited Warranties; Disclaimer

6.1 Workmanship. Any workmanship warranty will be described in your Service Document. Warranty coverage may be conditioned on proper use and maintenance and excludes normal wear/tear, customer-supplied parts, hidden/pre-existing conditions, and acts of third parties.

6.2 Manufacturer Warranties. Parts and equipment may carry manufacturer warranties, which govern their terms. We are not responsible for manufacturer warranty decisions.

6.3 Disclaimer. EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN SERVICE DOCUMENT, THE SITE AND ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WHITE GLOVE PLUMBING OR ITS OWNERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/REVENUE/GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, ONLINE SERVICES, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR ONLINE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Note: Different liability limits may apply to onsite services per your Service Document.

8) User Content & Acceptable Use

8.1 Your Content. If you submit reviews, comments, images, or other content (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with operating the Site and our business. You represent you have the rights to grant this license.

8.2 Prohibited Conduct. You agree not to:

  • Violate any law or third-party right.

  • Interfere with or disrupt the Site or attempt to probe/scan/test its vulnerability.

  • Upload malicious code, spam, or content that is unlawful, defamatory, obscene, harassing, or infringing.

  • Impersonate any person or misrepresent your affiliation.

  • Collect or harvest others’ information from the Site without permission.

We may remove or refuse any User Content at our discretion.

9) Intellectual Property

9.1 Ownership. The Site, including text, graphics, logos, icons, images, videos, software, and compilations, is owned by or licensed to White Glove Plumbing and protected by intellectual-property laws.

9.2 License to You. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. Any other use is prohibited.

9.3 Trademarks. White Glove Plumbing names, logos, and marks are trademarks of White Glove Plumbing. Other marks are the property of their respective owners.

10) Copyright/DMCA

If you believe content on the Site infringes your copyright, please send a notice that complies with 17 U.S.C. §512(c)(3) to office@whitegloveplumbingca.com with: (a) the work claimed to be infringed; (b) the allegedly infringing material and its location; (c) your contact info; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized agent; and (f) your physical or electronic signature. We may remove content and, in appropriate circumstances, terminate repeat infringers’ access.

11) Communications; SMS/Calls; Recording

11.1 Electronic Communications. You consent to receive electronic communications (emails, texts) related to your requests and account.

11.2 Marketing. With your consent where required, we may send promotional messages; you can opt out at any time (e.g., “unsubscribe” link, reply STOP to texts). Consent to marketing is not a condition of purchase.

11.3 Recording. We may monitor or record calls for quality and training with legally required notice.

12) Privacy

Our collection and use of personal information via the Site is described in our Privacy Policy. By using the Site, you acknowledge and agree to that policy.

13) Third-Party Links & Services

The Site may link to third-party websites/services. We are not responsible for their content, terms, or policies. Access them at your own risk.

14) Service Area; Licensing; Permits

14.1 Service Area. Our typical service area includes Santa Ana and surrounding communities; availability may vary.

14.2 Licensing. Where required, work is performed under applicable state/local licensing and code requirements.

14.3 Permits & Inspections. If permits or inspections are required, they may involve additional fees and timeframes outside our control.

15) Indemnification

You agree to indemnify, defend, and hold harmless White Glove Plumbing and its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) your User Content.

16) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including severe weather, natural disasters, labor issues, supply-chain disruptions, utility outages, pandemics, acts of government, or other force majeure events.

17) Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS.

17.1 Good-Faith Resolution. Before filing a claim, the parties will try in good faith to resolve disputes informally. Email office@whitegloveplumbingca.com with “Dispute” in the subject line and a description of the issue.

17.2 Binding Arbitration. Except for small-claims court or claims seeking injunctive relief for alleged IP misuse, any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by a reputable arbitration provider under its rules. The arbitration will take place in Orange County, California, unless otherwise required by law.

17.3 Class-Action Waiver. Disputes will be resolved only on an individual basis and not in a class, collective, consolidated, or representative action. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

17.4 Jury Trial Waiver. To the extent permitted by law, the parties waive the right to a jury trial.

17.5 Severability. If the arbitration/class-action waiver is found unenforceable, the remainder of this Section 17 will still apply to the extent permitted.

18) Governing Law & Venue

These Terms and any dispute between you and us related to the Site are governed by the laws of the State of California without regard to conflict-of-laws rules. Subject to the arbitration provision, the exclusive venue shall be the state and federal courts located in Orange County, California, and you consent to their jurisdiction.

19) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you violated these Terms. Sections that by their nature should survive (e.g., IP, warranty disclaimer, limitation of liability, indemnification, dispute resolution) will survive termination.

20) Changes to the Site and to These Terms

We may modify or discontinue the Site (in whole or part) at any time without liability. We may change these Terms by posting an updated version with a new “Last Updated” date. Changes become effective upon posting. Your continued use of the Site after changes take effect constitutes acceptance.

21) International Use

The Site is controlled and operated from the United States. We do not represent that the Site is appropriate or available for use in other locations. You are responsible for compliance with local laws.

23) Miscellaneous

23.1 Entire Agreement. These Terms, together with the Privacy Policy and any applicable Service Document, constitute the entire agreement regarding your use of the Site.

23.2 Severability. If any provision is found invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23.3 No Waiver. Our failure to enforce any provision is not a waiver of our rights.

23.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

23.5 Headings. Headings are for convenience only and do not affect interpretation.
